These Terms of Service (“Terms”) govern your access to and use of Caspian AI (“we”, “our”, or “us”), an AI-powered email management service. By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the service.

Agreement to Terms

By creating an account, connecting your Gmail account, or using Caspian AI in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Caspian AI.

Description of Service

Caspian AI is an AI-powered email management tool that helps you automatically archive low-priority emails from your Gmail account. The service:

  • Analyzes email metadata (sender, subject, date, snippet) using AI to classify emails based on their temporary importance
  • Assigns “relevance horizons” to emails (2 days, 7 days, 30 days, or durable/keep forever)
  • Automatically archives emails after their relevance period expires
  • Provides a dashboard where you can review classifications and override decisions

Important: Caspian AI only processes email metadata and headers. We never read or store full email content. All archiving is done through Gmail’s API and only changes email labels—emails are not permanently deleted.

Eligibility and Age Requirements

You must be at least 13 years old to use Caspian AI. By using the service, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • You have the authority to connect and manage the Gmail account(s) you link to Caspian AI

Account Registration and Security

Account Creation

  • You must provide accurate, current, and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

Gmail Account Connection

  • You must have a valid Gmail account to use Caspian AI
  • When connecting your Gmail account, you grant Caspian AI permission to:
    • Read email headers and metadata (sender, subject, date, labels)
    • Modify email labels (required for archiving)
  • You acknowledge that connecting your Gmail account is subject to Google’s Terms of Service and Privacy Policy
  • You are responsible for ensuring you have the right to connect any Gmail account to Caspian AI

User Responsibilities

You agree to:

  1. Review Classifications: Review AI classifications before emails are archived. While Caspian AI provides classification suggestions, you are responsible for ensuring important emails are not archived inappropriately.

  2. Use Service Appropriately: Use Caspian AI only for lawful purposes and in accordance with these Terms. You agree not to:

    • Use the service to violate any laws or regulations
    • Attempt to gain unauthorized access to any part of the service
    • Interfere with or disrupt the service or servers
    • Use automated systems to access the service without permission
    • Reverse engineer, decompile, or disassemble any part of the service

  3. Maintain Account Security: Keep your account credentials secure and notify us immediately of any security breach

  4. Comply with Third-Party Terms: Comply with all applicable terms from third-party services we use, including:

    • Google’s Terms of Service (for Gmail API)
    • Clerk’s Terms of Service (for authentication)
    • OpenAI’s Terms of Service (for AI classification)

AI Classification and Accuracy

AI Limitations

Caspian AI uses artificial intelligence (OpenAI) to classify emails. You acknowledge and agree that:

  • AI is not perfect: The AI classification system may make errors or misclassify emails
  • No guarantees: We do not guarantee the accuracy, completeness, or reliability of AI classifications
  • Your responsibility: You should review classifications before archiving and override any decisions you disagree with
  • No liability for misclassification: Caspian AI is not liable for any consequences resulting from AI misclassification, including but not limited to:
    • Important emails being archived
    • Emails being archived at incorrect times
    • Any business or personal losses resulting from classification errors

Classification Review

  • You can review all email classifications in your dashboard
  • You can override any AI classification before archiving
  • You can turn the automatic archiving service on or off at any time
  • Once an email is archived, you can manually unarchive it in Gmail

Service Availability and Modifications

Service Availability

  • Caspian AI is provided “as is” and “as available”
  • We do not guarantee that the service will be available at all times or without interruption
  • We may experience downtime due to maintenance, updates, or technical issues
  • We are not liable for any losses resulting from service unavailability

Service Modifications

We reserve the right to:

  • Modify, suspend, or discontinue any part of the service at any time
  • Change features, functionality, or pricing with reasonable notice
  • Update these Terms at any time (see “Changes to Terms” below)

Limitation of Liability

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASPIAN AI IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF AI CLASSIFICATIONS
  • UNINTERRUPTED OR ERROR-FREE SERVICE

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CASPIAN AI, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
  • ANY DAMAGES RESULTING FROM:
    • AI MISCLASSIFICATION OF EMAILS
    • SERVICE UNAVAILABILITY OR INTERRUPTIONS
    • UNAUTHORIZED ACCESS TO YOUR ACCOUNT
    • ERRORS OR OMISSIONS IN THE SERVICE
    • DELAYS IN PROCESSING OR ARCHIVING EMAILS

Maximum Liability

Our total liability to you for any claims arising from or related to the service shall not exceed the amount you paid to Caspian AI in the 12 months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Caspian AI, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your connection of a Gmail account you do not have permission to access
  • Any consequences resulting from your failure to review AI classifications

Intellectual Property

Our Intellectual Property

  • All content, features, and functionality of Caspian AI are owned by us or our licensors
  • Our trademarks, logos, and service marks are our property
  • You may not use our intellectual property without our prior written consent

Your Content

  • You retain all rights to your email data
  • By using Caspian AI, you grant us a limited license to process your email metadata as necessary to provide the service
  • This license terminates when you disconnect your Gmail account or delete your account

Data and Privacy

Your use of Caspian AI is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the service, you consent to our data practices as described in the Privacy Policy.

Key points:

  • We only process email metadata, never full email content
  • All Gmail OAuth tokens are encrypted at rest (AES-256-GCM)
  • You can disconnect your Gmail account or delete your account at any time
  • We do not sell your data to third parties

Termination

Termination by You

You may stop using Caspian AI at any time by:

  • Disabling the automatic archiving service in your dashboard
  • Disconnecting your Gmail account from your dashboard (this revokes our access and deletes all associated email data)
  • Deleting your account through your profile settings (this permanently removes all your data from our systems)

Termination by Us

We may suspend or terminate your access to Caspian AI immediately, without prior notice, if:

  • You violate these Terms
  • You engage in fraudulent, abusive, or illegal activity
  • You fail to pay any fees (if applicable)
  • We are required to do so by law
  • We discontinue the service

Upon termination:

  • Your right to use the service will cease immediately
  • We may delete your account and associated data
  • You remain responsible for any obligations incurred before termination

Third-Party Services

Caspian AI integrates with third-party services:

  • Gmail API: For email access and archiving (subject to Google’s Terms)
  • Clerk: For user authentication (subject to Clerk’s Terms)
  • OpenAI: For AI classification (subject to OpenAI’s Terms)
  • Resend: For transactional email delivery (welcome emails, daily digests, invitations)
  • Sentry: For error monitoring in production
  • Google Analytics: For anonymous pageview analytics in production

You acknowledge that:

  • Your use of these third-party services is subject to their respective terms and conditions
  • We are not responsible for the availability, accuracy, or practices of third-party services
  • We are not liable for any issues arising from third-party service failures

Dispute Resolution

Informal Resolution

If you have any concerns or disputes about the service, you agree to first contact us to try to resolve the dispute informally.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Caspian AI operates, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising from or related to these Terms or the service shall be resolved in the courts of the jurisdiction where Caspian AI operates.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will:

  • Post the updated Terms on this page
  • Update the “Last updated” date
  • Provide reasonable notice (at least 30 days) for material changes
  • Send an email notification for significant changes (if you have an account)

Your continued use of Caspian AI after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the service.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Caspian AI regarding the service and supersede all prior agreements and understandings.

Early Access Notice

Caspian AI is currently in early access. During this phase:

  • The service may be unstable or unavailable at times
  • Features may change without notice
  • We may collect feedback and usage data to improve the service

By using Caspian AI during early access, you acknowledge these limitations and agree to provide feedback to help improve the service.

By using Caspian AI, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
